The RESET Act Would Bar Most Mid-Decade Redistricting – H.R. 5837

Rep. Don Davis (D-NC-01) introduced the Restoring Electoral Stability to Enhance Trust Act (RESET Act) (H.R. 5837), legislation that would ban mid-decade redistricting (both retroactively and proactively).

States that have already undergone redistricting after a post-decennial census apportionment would be prohibited from being “redistricted again until after the next apportionment of Representatives.”

The RESET Act would have exceptions for when a court requires or conducts, or a State orders a statewide referendum to conduct, a “subsequent redistricting” for Constitutional or Voting Rights Act compliance.

The bill would not affect how a state conducts election for state or local office, or “the process by which a State establishes the districts used in such elections.”

This legislation would apply “to any Congressional redistricting which occurs after the regular decennial census conducted during 2020” and any “statewide referenda ordered after November 3, 2026.”

H.R. 5837 has no cosponsors. It was referred to the House Judiciary Committee.
